These Terms and Conditions govern access to lydenburg.africa, user accounts, business and event listings, listing claims, paid plans, promotions, advertising and related services.

Please read these terms before using the website or placing an order. By creating an account, submitting content, claiming a listing or purchasing a service, you agree to these terms to the extent permitted by applicable law. Nothing in these terms excludes a right or remedy that cannot lawfully be excluded.

These operator details are supplied for legal notices, service enquiries and consumer complaints.

2. Nature of the service

Lydenburg Africa is an online directory and local-information platform. It provides tools for discovering and publishing information about businesses, organisations, places and events. It may also display editorial content, paid promotions, sponsored material and third-party advertising.

We are not a party to transactions between a visitor and a listed business, event organiser, advertiser or external booking provider. Users must make their own enquiries and decisions. A listing, verification badge, review, advertisement or position in search results is not a guarantee, certification or endorsement of quality, safety, licensing, availability or future conduct.

3. Eligibility and accounts

You must provide accurate information when registering and must be legally capable of entering into the relevant agreement. If you act for a business or organisation, you confirm that you have authority to bind it and to submit or manage its information.

You are responsible for safeguarding your login details and for activity performed through your account. Notify us promptly if you suspect unauthorised access. We may require identity, ownership or authority checks before approving a claim, changing sensitive details or restoring account access.

4. Listings and event submissions

Listing features, limits, duration and prices are described on the relevant package or product page at the time of order. The current business-listing options include Free, Standard and Featured plans. Event listings and optional promotion products may be subject to separate feature limits.

You must ensure that submitted information is accurate, current, relevant and not misleading. Dates, prices, addresses, contact details, availability and event information should be updated when they change. You may submit only content and media that you own or are authorised to use.

Submission or payment does not guarantee publication. We may review, request changes to, refuse, suspend, edit for formatting, categorise or remove content where reasonably necessary to enforce these terms, protect users, comply with law or maintain the integrity of the directory. Material factual or promotional changes will not intentionally be made on behalf of an owner without appropriate grounds.

5. Unclaimed listings and ownership claims

We may create an unclaimed listing using information that is lawfully available to the public. An unclaimed listing does not establish a commercial relationship or endorsement. A business owner or authorised representative may request correction, removal where legally justified, or control of the listing.

Claimants must provide truthful information and may be asked for reasonable evidence of authority, such as an email from the business domain, supporting documentation or another verification method. We may decline or reverse a claim where evidence is insufficient, fraudulent or disputed. Competing ownership disputes may require the parties to resolve their authority independently.

6. Verification badges

Verification is performed manually and is not automatically included merely because a listing is free or paid. A badge records that specified checks were completed at a particular time. It does not guarantee regulatory compliance, financial standing, quality, safety or future behaviour. We may request re-verification or remove a badge if information changes or credible concerns arise.

7. Plans, prices, VAT and payment

Prices, included features and applicable durations are shown before an order is placed. Unless clearly stated otherwise, prices displayed to customers include VAT. Payment must be made using an available payment method. The customer must review the complete order and correct errors before confirming payment.

Paid business-listing plans currently run for 365 days and renew manually. They do not automatically create a recurring annual charge. A listing may expire or lose paid features if it is not renewed. Product details shown at checkout form part of the transaction record.

We may correct an obvious pricing or technical error before activation. If an order cannot be fulfilled at the displayed price because of such an error, the customer will be offered the corrected transaction or a cancellation and refund.

8. Activation and performance

A paid service begins when the applicable plan or promotion is activated, or when we otherwise start performing the purchased service. Activation may depend on successful payment, submission of required information and completion of reasonable review. We will perform accepted services within the agreed period and in accordance with applicable law.

9. Cancellations and refunds

Customers must review the plan, price, duration and included features before placing an order. A request to remove a listing, advertisement or promotion, or a decision not to use all available features, does not by itself create an automatic entitlement to a full or pro-rata refund.

Statutory cancellation rights: where section 44 of the Electronic Communications and Transactions Act 25 of 2002 applies, an eligible consumer may cancel an online transaction for services without reason and without penalty within seven days after conclusion of the agreement. Where payment has already been made, the refund must be processed within the period required by law. This cooling-off right may not apply to a service that began with the consumer’s consent before the end of that seven-day period. Nothing in these terms excludes rights that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or any other applicable law.

Immediate activation: where a customer expressly requests or agrees that a listing, advertisement, promotion or related digital service may be activated immediately, the customer consents to performance beginning before the end of any otherwise applicable cooling-off period. Any consequence of that consent applies only to the extent permitted by law.

Subject to statutory rights and any other applicable law:

  • A cancellation requested before activation or commencement of the service may be accepted and refunded.
  • Duplicate, unauthorised or incorrectly processed charges will be investigated and refunded where verified.
  • If Lydenburg Africa cannot provide an accepted paid service, the affected payment will be refunded.
  • If a service is materially defective or not provided as agreed, Lydenburg Africa may correct or re-perform the service, provide an appropriate price reduction, or issue a refund where required by law.
  • Where submitted content does not meet the listing or advertising requirements, the customer will ordinarily be given a reasonable opportunity to correct it before final refusal.
  • After any applicable statutory cancellation period and once a service has commenced, voluntary cancellation, downgrading or removal does not ordinarily result in a full or pro-rata refund, except where required by law or expressly agreed in writing.
  • No refund is due merely because a listing, advertisement or promotion receives fewer views, enquiries, bookings or sales than expected, or does not achieve a desired search-engine or directory position.
  • Any cancellation charge imposed where legally permitted must be reasonable in the circumstances and must not negate a statutory right to cancel.

Cancellation or refund requests must be submitted through the Contact page and should include the account email address, order number and reason for the request. Approved refunds will be returned through the original or another appropriate payment method within the period required by applicable law or the payment provider. Nothing in this section limits a non-excludable consumer right.

10. Featured placement and promotions

Featured listings and promotions may receive additional internal visibility for the applicable period. Placement remains subject to relevance, filters, location, availability, technical operation, search order and fair sharing among eligible listings. Positions can change and a particular first position is not guaranteed.

We do not guarantee Google rankings, website traffic, listing views, enquiries, bookings, attendance, revenue or sales. A promotion ending does not change the underlying listing plan unless expressly stated.

11. Prohibited content and conduct

You may not use the website to publish or facilitate content that:

  • is false, fraudulent, materially misleading or impersonates another person or organisation;
  • infringes copyright, trade marks, privacy, confidentiality or other rights;
  • is unlawful, defamatory, threatening, discriminatory, exploitative or promotes prohibited goods or services;
  • contains malware, malicious links, scraping, automated abuse or attempts to interfere with the website;
  • manipulates reviews, claims, categories, tags, statistics or search visibility;
  • publishes another person’s sensitive information without lawful grounds;
  • duplicates listings or uses irrelevant keywords, locations or categories to obtain unfair exposure; or
  • otherwise creates a material risk to users, the directory or third parties.

12. Reviews and user contributions

Reviews must reflect genuine experiences and must not be bought, fabricated, posted in exchange for undisclosed benefits or used to harass competitors. Listed businesses may respond to reviews but may not threaten or improperly incentivise reviewers. We may moderate content under these terms while respecting lawful opinion and fair comment.

13. Intellectual property and content licence

You retain ownership of content you lawfully submit. You grant Lydenburg Africa a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, format, display and distribute that content as reasonably required to operate, promote and improve the listing or service. This licence ends when the content is removed, except for reasonable backups, legal records and material already lawfully distributed.

The Lydenburg Africa website, branding, original editorial material, layout and software are protected by applicable intellectual-property laws. No right is granted to copy, scrape, republish or commercially exploit them except as permitted by law or with written permission.

14. Third-party links, bookings and advertisements

Listings may contain telephone, WhatsApp, website, social-media, map, booking, ticketing or document links controlled by third parties. We do not operate or guarantee those services and are not responsible for their terms, privacy practices, availability or transactions.

Advertisements and sponsored content may be displayed. Their presence does not amount to an endorsement. Commercial content will be identified where its nature may not otherwise be reasonably clear.

15. Availability and changes

We aim to keep the website available but do not guarantee uninterrupted or error-free operation. Maintenance, security events, hosting failures, third-party services and circumstances outside reasonable control may affect availability. We may change or discontinue features where reasonably necessary, while honouring paid services and consumer rights to the extent required by law.

16. Suspension and termination

We may restrict, suspend or terminate access or remove content for a material breach, fraud, unlawful activity, non-payment, security risk or repeated abuse. Where appropriate, we will provide notice and an opportunity to correct the breach. Immediate action may be taken where reasonably necessary to prevent harm, comply with law or preserve evidence.

17. Disclaimers and limitation of liability

Directory information can change and may be supplied by third parties. Although we may review or correct information, users should confirm important details directly with the relevant business, organiser or authority before travelling, purchasing, booking or relying on it.

To the fullest extent permitted by law, Lydenburg Africa is not liable for indirect, consequential or purely economic loss arising from third-party conduct, inaccurate user content, external services or decisions made solely in reliance on directory information. This does not exclude liability that cannot lawfully be excluded, including liability arising from gross negligence or other non-excludable statutory obligations.

18. Personal information and cookies

Personal information is handled as described in the Privacy Policy. The use of cookies and related technologies is described in the Cookie Policy. Users must not add personal information to a listing unless they have lawful grounds and authority to do so.

19. Complaints and disputes

Please first contact us with the listing URL, order number or account details relevant to the complaint. We will attempt to resolve the matter in good faith. A consumer may also have the right to approach an applicable consumer-protection body, the Information Regulator or a court with jurisdiction.

These terms are governed by the laws of the Republic of South Africa. Subject to applicable consumer rights and jurisdictional rules, disputes are subject to the jurisdiction of the competent South African courts.

20. Changes to these terms

We may update these terms to reflect legal, operational or service changes. The updated version will show its effective date. Material changes affecting an existing paid service will be communicated where reasonably required. Changes do not retrospectively remove accrued rights.
